Roundabeat Mobile App Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the RoundaBeat Metronome mobile application (the “App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

RoundaBeat Metronome is a mobile application designed to provide metronome functionality for musicians and music learners. The App provides:

  • Adjustable tempo settings (BPM)
  • Various time signatures
  • Multiple metronome sound options
  • Visual beat indicators
  • Tap tempo functionality
  • Offline operation

3. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use.

You May:

  • Use the App for personal music practice and learning
  • Adjust settings and preferences as intended
  • Use the App offline without internet connection

You May NOT:

  • Reverse engineer, decompile, or disassemble the App
  • Modify, adapt, or create derivative works of the App
  • Remove or alter any copyright, trademark, or other proprietary notices
  • Use the App for any commercial purpose without our written consent
  • Distribute, sell, lease, or sublicense the App
  • Use the App in any way that violates applicable laws or regulations

4. Intellectual Property Rights

The App and all its content, features, and functionality are owned by RoundaBeat and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

All trademarks, service marks, and logos used in the App are the property of their respective owners.

5. User Conduct

You agree to use the App in a responsible manner and not to:

  • Use the App in any way that could damage, disable, or impair the App
  • Attempt to gain unauthorized access to any part of the App
  • Use the App to transmit any harmful, illegal, or objectionable content
  • Interfere with other users’ use and enjoyment of the App

6. Privacy

We do not warrant that:

  • The App will be uninterrupted or error-free
  • Defects will be corrected
  • The App is free of viruses or other harmful components
  • The results of using the App will meet your requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ROUNDABEAT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY).

11. Indemnification

You agree to indemnify, defend, and hold harmless RoundaBeat and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the App or violation of these Terms.

12. Audio and Hearing Safety

Important Safety Notice:

  • Use appropriate volume levels to protect your hearing
  • Be aware of your surroundings when using headphones
  • Take regular breaks during extended practice sessions
  • Consult a medical professional if you experience hearing discomfort

You acknowledge that prolonged exposure to loud sounds can cause hearing damage, and you use the App at your own risk regarding audio volume levels.

13. Age Restrictions

The App is suitable for users of all ages. However, children under 13 should use the App under parental supervision to ensure appropriate volume levels and safe usage.

14. Termination

These Terms are effective until terminated. You may terminate these Terms at any time by deleting the App from your device. We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms.

Upon termination, your right to use the App will cease immediately, and you must delete all copies of the App from your devices.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remainder of these Terms will remain in full force and effect.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of [Your State], without regard to conflict of law principles.

For Google Play Store Users: These Terms are between you and RoundaBeat only, not Google Inc. Google is not responsible for the App or its content.
